Information clause for Contractors,
their representatives, employees and collaborators
 
Fulfilling the obligation resulting from Article 13 and Article 14 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) - hereinafter referred to as "GDPR", we would like to inform you that:
1. The administrator of your personal data is Toyo Seal Poland spółka z ograniczoną odpowiedzialnością with its registered office in Tychy, Cielmicka 60, 43-100 Tychy, which is entered into the Register of Entrepreneurs of the National Court Register under number 0000084666 (hereinafter referred to as TSP).
2. TSP has not appointed a Data Protection Officer. In matters related to the protection of personal data, TSP can be contacted in person or by the post address indicated above or by e-mail address: rodo-tsp@toyoseal.com
3. TSP collects and processes your personal data:
a) if you are a party to the contract - in order to conclude or implement the provisions of the concluded contract, as well as to fulfill the legal obligations incumbent on TSP in connection with the concluded contract, in particular in the field of tax regulations. The legal basis for the processing of personal data in this respect is Article 6(1)(b) of the GDPR and Article 6(1)(c) of the GDPR in conjunction with the provisions of generally applicable law, in particular tax law;
b) if you represent a party to the contract - in order to conclude or implement the provisions of the concluded contract, which is a legitimate interest pursued by TSP. The legal basis for the processing of personal data in this respect is Art. 6 para. 1 lit. f GDPR;
c) in order to establish, assert or defend claims which TSP may assert or which may be asserted against it in connection with the concluded contract. The above-mentioned purposes constitute a legitimate interest pursued by TSP. The legal basis for the processing of your data in this respect is Art. 6 para. 1 lit. f GDPR;
d) for other purposes, in the event of your voluntary written consent. The legal basis for the processing of your personal data in this respect is Art. 6 para. 1 lit. a GDPR.
4. If your personal data have been made available to TSP by you yourself – we would like to inform you that providing data is a contractual requirement. Providing your personal data is not mandatory, but their absence would prevent the conclusion of the contract. In the event that personal data will be processed on the basis of consent, providing personal data is voluntary, and failure to provide them will result in their non-use for the purposes indicated in the consent clause.
5. In the event that your personal data have been made available to TSP in connection with the performance of the contract, we hereby inform you that the provider was your employer / principal / ordering party, who is a party to the contract. In connection with the above, we have received the following data: name, position and place of work and contact details (telephone number and e-mail address). In the case of personal data of persons representing the contractor, their name and surname have been determined on the basis of publicly available registers (e.g. the register of entrepreneurs of the National Court Register).
 6. The recipients of personal data may be, in particular: public administration bodies, in particular the Tax Office (for purposes specified by generally applicable law); other contractors, TSP suppliers and subcontractors, banks (for the sole purpose of paying remuneration), providers of technical/organizational services and solutions (IT service providers, courier companies, postal companies), as well as accounting offices and law firms acting on behalf of TSP.
7. TSP may transfer your personal data to Japan, i.e. outside the European Economic Area. According to the decision of the European Commission, effective from January 23, 2019, Japan ensures an adequate level of protection of personal data, which confirms that your personal data is safe.
8. Your personal data will be processed for the period necessary to perform, terminate or expire the concluded contract, and will also be processed for the duration of TSP's legitimate interest, i.e. until the claims arising from the concluded contract expire. In the scope of personal data processed in connection with obligations arising from the provisions of generally applicable law, your personal data will be processed for the period required by these provisions. In the case of personal data processed on the basis of consent – personal data will be processed until the purpose for which they were collected ceases or until the consent is withdrawn.
9. TSP informs each person whose data is processed that, on the terms resulting from the GDPR, it has the right to request from TSP access to its personal data, rectification, deletion or limitation of processing, as well as to demand their transfer. 10. You have the right to object to the processing of your personal data if the processing of your personal data is based on a legitimate interest (Article 6(1)(f) of the GDPR). In such a situation, TSP will no longer be able to process your data, unless it has a valid legitimate basis for doing so, overriding your rights and freedoms or a basis for establishing, pursuing or defending its claims. You can submit this objection directly to TSP (contact details are indicated above).
11. If your personal data is processed on the basis of your consent (Article 6(1)(a) of the GDPR), you have the right to withdraw it at any time, which, however, does not affect the lawfulness of the processing carried out before the withdrawal of this consent. The declaration of withdrawal of consent may be sent directly to TSP (contact details are indicated above).
12. If, in your opinion, TSP has violated the provisions on the protection of personal data, you have the right to lodge a complaint with the competent supervisory authority, i.e. the President of the Office for Personal Data Protection (contact details: Stawki 2, 00-193 Warsaw).
13. The personal data provided by you will not be processed automatically (i.e. without human intervention), in particular they will not be subject to profiling.
